Express Trademarks for New York Businesses and Elsewhere–Looking to Foreign Territories

There comes a time in any brand’s life when trademark registration goes from a nice idea to a critical must have item.  This is especially true in those instances where there is a pending confrontation between your brand and another brand that may result in litigation (or where the IP right is necessary to cement some form of business transaction such as a loan or acquisition).  What is one to do when these events are bearing down and there is no registration for the mark?  Look to “quick fix” territories in the world that provide expedited or accelerated processes.

For example, the Benelux territories offer an expedited registrations process that can facilitate registration in a few weeks which is retroactively effective to the time of the application’s filing.  That registration can then be used to piggy back rights on a seniority basis in other territories such as the United States, under certain circumstances.  More information on that expedited process can be found here.
