Internet Counterfeit Lawsuit Pitfalls for a New York and Any Brand

The Court in the case of Mayhew v. Dunn et al. dealt with a plaintiff claiming that posts on defendant’s web site regarding plaintiff’s conduct resulted in a flurry of harassing phone calls and communications. In support of its position that the Communications Decency Act (“CDA”) acted as shield to the defendant web site operator, the Court cited Olivera Medenica’s analysis of the decision in Zeran v. America Online, Inc. ’s, 129 F. 3d 327(4th Cir. 1997), impact on web site owners across the board.  In short, Zeran can protect a web site operator from liability in a broad range of situations.
